This Declaration of Consent relates to the auditing of:

1. The Producer agrees that the individual auditors working on behalf of or otherwise representing a BSCI-accredited Auditing Company (the ‘Auditor’ or ‘Auditors’) take photos of the factory and factory compound as well as take copies of business documents.
生产商同意代表BSCI认可的审核公司的审核员可以在工厂和工厂范围内拍照，以及复印文件。
2. The Producer agrees that the Auditors may conduct confidential interviews with employees who are chosen by the Auditors freely without any influence from the Producer.

3. The BSCI provides an additional communication channel for workers and companies, which is printed as an official BSCI Complaint Card. The information is also displayed on the BSCI Code of Conduct. Auditors have the mandate to distribute those cards as part of the standard BSCI audit procedure. This applies in countries where the BSCI Complaint Mechanism is active. The Producer agrees that the Auditors will distribute the BSCI Complaint Card among workers.

4. The Producer agrees that all audit information will be recorded in a database made available by or on behalf of the FTA for services related to the BSCI. This database allows sharing of the audit results among BSCI Participants.
生产商同意所有信息被记录在外贸协会(FTA)组织或代表其的数据库中，以便为[倡议商界遵守社会责任组织](BSCI)提供服务。该数据库允许BSCI成员间共享审核结果。
5. The Producer agrees that the Auditors may pass the Audit Questionnaire, Audit Reports and annexes directly to the Producer’s retail customer or agency that is a member of the FTA.
生产商同意审核员将审核问卷表，审核报告及相关附件直接发给FTA成员(包括BSCI成员)，或其地方办事处/代理。
6. The Producer agrees that data can be passed to third parties (i) insofar as such transfer is necessary for the provisions by or on behalf of FTA of BSCI-related services, or (ii) insofar as this occurs within the framework of the BSCI. Case (ii) of this article is understood as referring to the following situations:
a) Dialogue and cooperation with non-government organizations and other stakeholders at BSCI meetings aiming at enhancing the BSCI activities.
b) Cooperation with these stakeholders and the BSCI Secretariat to find solutions in connection with the BSCI Complaint Mechanism.
Data passed to these parties is treated confidentially. The Auditing Company and the BSCI Secretariat are not liable in case of misuse by other parties.

7. The producer agrees that the Auditors conducting the BSCI social audit can be subject to a Witness Audit. Witness Audits aim at ensuring the quality of Auditors / Auditing Companies performing BSCI audits and has no incidence on the performance or results of the Producer. There is no additional cost for the Producer and the results will not affect the status of the Producer. The Producer agrees that if requested, their BSCI social audit will include a Witness Audit and the additional Auditors will be allowed access to the facility.
生产商同意审核员执行BSCI监督审核。监督审核的目的在于确保审核员/审核公司执行BSCI审核的审核质量并且监督审核不会对生产商的本次表现或结果造成影响。生产商无需对监督审核支付额外费用。生产商同意BSCI社会责任审核中将包括监督审核以及监督审核员被允许接触到生产商设施。
8. The Producer agrees that the facility can be subject to a Duplicate Audit. Duplicate Audits are conducted unannounced and shortly after a regular BSCI social audit takes place, to ensure that the reported results are accurate. Since this is a measure to control the quality of the Auditors and Auditing Companies, the Producer is not charged for this activity. In cases where the results from the duplicate audit differ from the results of the BSCI social audit, the Auditing Company may be requested to conduct a re-audit and they will be recommended not to charge the cost of the activity. The Producer agrees that if requested, Auditors will be allowed to conduct an unannounced Duplicate Audit.

9. The Producer agrees that the facility can be subject to a Random Unannounced Check. This check is a full BSCI audit and overrules the applicable audit cycle. The audit is ordered directly by the BSCI Secretariat to one of the accredited Auditing Companies. This measure aims at ensuring that previous audit results (particularly when the Producer receives “Good” results) are maintained.
a. If the result of the Random Unannounced Check is scored ‘’Good’’, the Secretariat will pay the Auditing Company for the visit and no further steps are needed.
b. If the result is “Improvements needed” or “Non-compliant” the Auditor will issue a Corrective Action Plan and a re-audit will be necessary later, following all the regular BSCI rules. In this case the Producer will be invoiced directly by the Auditing Company for the performance of the Random Unannounced Check, the subsequent re-audit and any related travel expenses.
The Producer agrees to give access to Auditors performing Random Unannounced Checks and to abide by the payment rules described under 9.b.

a. 若随机不通知检查的结果为“好”，BSCI秘书处将支付审核费用并且无需进一步跟进。
b. 若随机不通知检查的结果为“需要改进”或“不符合”，审核员会发放一份纠正行动计划给生产商并且会安排一次跟进审核，跟进审核将按照BSCI正常的规则进行。在这种情况下，生产商需支付随机不通知检查、跟进审核以及相关的差旅费用。
生产商同意审核员执行随机不通知检查并且遵守9.b中提出的费用支付准则。
1. The Producer agrees that this Declaration of Consent is governed by Belgian law, and that the courts of Brussels (Belgium) will have sole and exclusive jurisdiction over any disputes arising out of this Declaration of Consent.
生产商同意该同意声明书在比利时法律下管理，如果对此同意声明书有任何争议，布鲁塞尔法庭拥有其唯一的审判权。
